Application Terms and Conditions of Use

1. Purpose

The APPLICATION aims to:

1. 1. Fulfill commercial, labor, corporate, and accounting obligations.
2. 2. Transmit data to third parties with whom contracts have been concluded for this purpose, for contractual, administrative, and/or operational purposes.
3. 3. For security or fraud prevention purposes.
4. 4. Provide services contracted by the user.
5. 5. Send promotional information electronically.
6. 6. Manage contact requests received through various channels enabled in the APPLICATION.
7. 7. Create and manage user accounts (email, password, nickname).
8. 8. Access and use main functionalities (diary, anonymous chat, motivational cookies, letters and capsules, reminders).
9. 9. Manage redirection to official emergency services in the country, such as the Telephone of Hope, to facilitate immediate assistance when the user presses the SOS button.
10. 10. Content moderation and risk behavior detection (Google AI: sensitive images and words).
11. 11. Payment and subscription management.
12. 12. Storage and hosting.
13. 13. Service personalization and recommendations.
14. 14. Assistance with psychologists or coaches within the app.

The groups that can benefit from this project are APPLICATION users. Professional specialists have been involved in the design and development of this APPLICATION. The APPLICATION is made available to users for personal use (never business). It works on a mobile phone with Android or iOS operating system.

2. Permissions

For the proper functioning of the APPLICATION, it may request access to certain elements of the user's device. The required permissions are as follows:

1. 1. IP Address: is automatically collected when using the APPLICATION, in order to guarantee security, user authentication, and proper service provision.
2. 2. Camera: is requested only when the user performs actions that require capturing images or video within the application. Its use is strictly limited to the necessary functionality of the APPLICATION.
3. 3. Microphone: is requested only when the user uses audio functions within the APPLICATION. Access is limited to operations that the user explicitly authorizes.

All data obtained through these permissions is processed in accordance with current data protection regulations and only for the indicated purposes, guaranteeing the privacy and security of user information.

3. Intellectual and Industrial Property Rights

Intellectual and industrial property rights over the APPLICATION are owned by OASYS NEST, S.L.U., with exclusive exercise of exploitation rights in any form and, especially, reproduction, distribution, public communication, and transformation rights.

Third-party holders of intellectual and industrial property rights over photographs, logos, and any other symbols or content included in the APPLICATION have granted corresponding authorizations for their reproduction, distribution, and public availability.

The user acknowledges that reproduction, modification, distribution, commercialization, decompilation, disassembly, use of reverse engineering techniques, or any other means to obtain the source code, transformation, or publication of any result of unauthorized reference tests of any of the elements and utilities integrated within the development constitutes an infringement of OASYS NEST, S.L.U's intellectual property rights, consequently committing not to perform any of the mentioned actions.

5. Mandatory or Optional Nature of Information Provided by the User

Users, by checking the corresponding boxes and entering data in fields marked with an asterisk (*) in APPLICATION forms, expressly and freely and unequivocally accept that their personal data is necessary to attend to their request by the provider, with inclusion of data in remaining fields being voluntary. The user guarantees that personal data provided to OASYS NEST, S.L.U is truthful and is responsible for communicating any modification thereof.

OASYS NEST, S.L.U informs that all data requested through the APPLICATION is mandatory, as it is necessary to provide optimal service to the User. If all data is not provided, there is no guarantee that information and services provided will be completely tailored to your needs.

6. Security Measures

In accordance with current personal data protection regulations, the CONTROLLER is complying with all provisions of GDPR and LOPDGDD regulations for processing personal data under its responsibility, and manifestly with the principles described in article 5 of GDPR, whereby they are processed lawfully, fairly, and transparently in relation to the interested party and adequate, relevant, and limited to what is necessary in relation to the purposes for which they are processed.

OASYS NEST, S.L.U guarantees that it has implemented appropriate technical and organizational policies to apply security measures established by GDPR and LOPDGDD in order to protect users' rights and freedoms and has communicated appropriate information for them to exercise them.

All information transfer that the APPLICATION performs with cloud servers, its own or third-party, is carried out in an encrypted and secure manner through a secure hypertext transfer protocol (HTTPS), which also guarantees that information cannot be intercepted.

7. Liability Exclusion

OASYS NEST, S.L.U reserves the right to edit, update, modify, suspend, delete, or terminate services offered by the APPLICATION, including all or part of its content, without prior notice, as well as to modify the form or type of access to it. Possible causes of modification may occur for reasons such as adaptation to possible legislative developments and changes in the APPLICATION itself, as well as those that may derive from existing type codes in the matter or for strategic or corporate reasons.

OASYS NEST, S.L.U will not be responsible for use of the APPLICATION by a minor, with download and use of the APPLICATION being the user's exclusive responsibility. The APPLICATION is provided «as is» and without any kind of warranty. OASYS NEST, S.L.U is not responsible for the final quality of the APPLICATION, nor that it serves and fulfills all its objectives. Notwithstanding the foregoing, OASYS NEST, S.L.U commits to the extent of its possibilities to contribute to improving the quality of the APPLICATION, but cannot guarantee the accuracy or currency of its content.

Responsibility for use of the APPLICATION belongs only to the user. Except as established in these Terms and Conditions, OASYS NEST, S.L.U is not responsible for any loss or damage that occurs in relation to downloading or using the APPLICATION, such as those produced as a consequence of failures, breakdowns, or blockages in APPLICATION operation. Likewise, OASYS NEST, S.L.U will not be responsible for damages produced as a consequence of improper or inadequate use of the APPLICATION by users.
